No.12/2010 On June 30th 2010, World Trade Organization (WTO) has released a notification on the Draft Commission Regulation amending Annex XIV of REACH, which lists the six substances that are subject to the authorisation requirements laid down in Title VII into Annex XIV. These six substances are musk xylene, MDA, HBCDD, DEHP, BBP and DBP. Theses substances were listed into the First Priority Substances List on June 1st 2009. The First Priority Substances List also includes Short Chain Chlorinated Paraffins (SCCPs) which was classified as Persistent Organic Pollutants (POPs), and the EU does not consider including it into Annex XIV at this stage.
According to the draft Commission Regulation, after the date specified for each substance ("sunset date"), the placing on the market and the use of those substances in the EU will only be possible for those operators who have been granted an authorisation in accordance with Articles 60-64 of REACH and for those who have submitted an application for authorisation before a given date ("latest application date"), but a decision has not yet been adopted.
The proposed date of adoption and that of entry into force is December 2010, and the final date for comments is 60 days from date of notification.
