FCC Compliance: New Requirements for Equipment Authorization and US Agent Representation

The Federal Communications Commission (FCC) recently has been actively implementing measures to safeguard national security against potential threats to the US communications supply chain.

FCC Compliance: New Requirements for Equipment Authorization and US Agent Representation

As an outcome, the FCC Report & Order 22-84 – Protecting Against National Security Threats to the Communications Supply Chain through the Equipment Authorization Program, listed equipment identified as covered and prohibited from equipment authorization.  Please be advised of the following new additional information that is required to be submitted to the FCC with every application for original equipment, C2PC, C3PC, and change in IDs received on or after February 6, 2023:

  • Certification/Attestation that equipment is not covered
  • Certification/Attestation that Applicant/Grantee is identified or is not identified on the covered list
  • US Agent for service of process
    • The individual or entity designated must be located in the US or its territories or possessions.
    • An applicant located in the US may designate itself as the agent.
    • The applicant must provide a written certification, which must be signed by both the applicant and the designated agent if the agent is different from the applicant.
    • If the agent does business with the FCC, then its FCC Registration Number (FRN) is required to be included on the attachment/certification letter designating the agent for service of process.
    • If the agent does no business with the FCC other than being designated as a US agent for service of process, only the grantee’s FRN is required to be provided.
